1. Who we are

Scribbitt is operated by Hot and Crispy Digital ("Scribbitt", "we", "us", "our"). By creating an account or using the service, you ("you", "user") agree to be bound by these Terms & Conditions. If you do not agree, do not use the service.

2. The service

Scribbitt is a software-as-a-service product that lets you upload, record, transcribe, search, and analyze audio and video conversations using AI. Features available depend on your plan.

3. Account & eligibility

You must be of legal age in your jurisdiction to use Scribbitt. If you use the service on behalf of an organization, you confirm you have authority to bind that organization to these terms. You are responsible for the confidentiality of your credentials and all activity under your account, and must keep your information accurate and up to date.

4. Acceptable use

You must not, and must not permit anyone else to:

use the service for any unlawful, fraudulent, or harmful purpose;
send spam, malware, or attempt to interfere with or probe the security of the service;
infringe the intellectual property or privacy rights of others;
upload recordings you do not have the legal right to process under applicable consent and recording laws;
scrape, reverse engineer, resell, or redistribute the service or its outputs except as expressly permitted;
circumvent technical limits, rate limits, or access controls.

5. AI-generated output

Scribbitt uses third-party AI models to produce transcripts, summaries, entities, and answers. AI output can be incomplete or inaccurate. You are responsible for reviewing output before relying on it, and Scribbitt is not a substitute for professional legal, medical, financial, or other regulated advice. You may not use the service to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak the underlying models. We may remove content, refuse outputs, or suspend accounts that violate these rules.

You retain ownership of the content you upload. You grant us a limited, worldwide, non-exclusive license to host, process, and transmit that content solely to provide the service. We retain all rights in the Scribbitt software, branding, and underlying technology.

6. Payments & subscriptions

Paid plans are sold through our reseller. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Buyer Terms and our Refund Policy.

7. Service availability

We work hard to keep the service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the service is provided "as is" and we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Suspension & termination

We may suspend or terminate your access if you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. On termination, your right to use the service ends and we may delete your content after a reasonable export window.

9. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for any indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where it cannot lawfully be limited.

You agree to indemnify Hot and Crispy Digital against claims arising from your content, your unlawful use of the service, or your breach of these terms.

10. Governing law

These terms are governed by the laws applicable at the registered place of business of Hot and Crispy Digital, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction.

11. Changes

We may update these terms from time to time. Material changes will be communicated through the service or by email. Continued use after the changes take effect constitutes acceptance.
